General terms and conditions
Consumer information for distance contracts and customer information for contracts concluded by electronic means
§ 1 Scope
Business relationships with the purchaser in respect of orders placed via the online shop are governed by the following general terms and conditions in the version valid at the time the order is placed.
§ 2 Formation of contract
The presentation of our products on our website constitutes merely an invitation to the customer to submit a contractual offer.
By submitting an order, the customer makes an offer within the meaning of section 145 of the German Civil Code (BGB). The customer receives confirmation of receipt of the order by email.
The contract with us is formed when we accept the customer's offer in writing or in text form within 2 working days of the order being submitted. The decisive point in this respect is the time at which the declaration of acceptance reaches the customer.
A working day is any calendar day that is not a Sunday or a statutory public holiday applicable throughout Germany.
§ 3 Delivery, shipping costs, passing of risk
Delivery is made at the shipping costs stated in each individual case. Where the customer is a consumer, we bear the shipping risk in every case, irrespective of the method of dispatch. Where the customer is a trader, all risks and hazards of dispatch pass to the customer as soon as the goods have been handed over by us to the appointed logistics partner.
§ 4 Retention of title
The goods delivered remain our property until the purchase price has been paid in full.
§ 5 Payments
Only those payment methods displayed to the customer during the ordering process are accepted.
§ 6 Liability for defects
a) Provisions applicable to the sale of new goods
In the case of the sale of new goods, the statutory rights in respect of defects apply.
b) Provisions applicable to the sale of used goods
Irrespective of the following provisions on the shortening of the limitation period for liability for defects in used goods, the limitation of claims for damages in the event of injury to life, body or health based on an intentional or negligent breach of duty on our part, or on an intentional or negligent breach of duty by our legal representative or our vicarious agents, remains unaffected. Furthermore, irrespective of the following provisions on the shortening of the limitation period for liability for defects in used goods, the limitation of claims for damages in respect of other losses based on an intentional or grossly negligent breach of duty on our part, or on an intentional or grossly negligent breach of duty by our legal representative or our vicarious agents, remains unaffected. Any liability under the German Product Liability Act likewise remains unaffected.
In all other respects, a liability period for defects of one year applies to used goods where the customer is a consumer. Liability for defects in used goods is otherwise excluded where the customer is a trader.
In all other respects, the statutory rights in respect of defects apply.
§ 7 Consumer information for distance contracts and customer information for contracts concluded by electronic means
a) We are not subject to any specific codes of conduct not mentioned above.
b) You can identify any input errors made when submitting your order at the final confirmation stage before sending your contractual declaration and correct them at any time before submitting the order using the delete and amend functions.
c) The essential characteristics of the goods we offer, as well as the period of validity of time-limited offers, can be found in the individual product descriptions within our online range.
d) The language available for the conclusion of the contract is English.
e) Complaints and claims in respect of defects can be submitted to the address stated in the supplier identification details.
f) The text of the contract is not stored by us and is therefore not accessible to you as a customer via us after the contract has been concluded.
g) Information on payment, delivery or performance can be found in the offer.
§ 8 Information on dispute resolution proceedings before a consumer arbitration body
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration body.
§ 9 Miscellaneous
The contractual relationship between us and the customer, as well as the respective terms and conditions, are governed by the law of the Federal Republic of Germany. Where the customer is a consumer, the statutory provisions and rights applicable for the protection of consumers under the law of the state in which the consumer has their habitual residence, and from which no derogation may be made by agreement, remain unaffected by this agreement. The application of the UN Convention on Contracts for the International Sale of Goods is excluded.
